Tracy Morgan is still recovering from his car wreck over the Summer and his lawyer, Benedict Morelli, has revealed that the comedian might never be "the Tracy Morgan he once was".

"He's fighting to get better, and if there's a chance for him to be back to the Tracy Morgan he once was, he's going to try to do that," Morelli said. "But we just don't know because of the severity of the injuries that he sustained and the fact that he had such a severe brain injury."

Morelli and other lawyers were in court in New Jersey for a scheduling conference in Morgan's lawsuit against Bentonville, Arkansas-based Wal-Mart Stores Inc., whose truck was involved in the crash. Morgan was not present at the hearing.

Morelli didn't discuss specific on Morgan's health condition but said he hasn't fully recovered.

"When you have a traumatic brain injury it takes a very long time to find out how you're going to do and how much you're going to recover," Morelli said. "You just don't know. So that's where he is. He's still fighting and trying to live his life at the same time and trying to get better, and he's just not better. We're hoping and praying to get him back to where he was. But the jury's out."

Tracy did release a statement earlier this Fall when he found out that Walmart was taking action. "After I heard what Walmart said in court I felt I had to speak out," Morgan said in a statement. "I can't believe Walmart is blaming me for an accident that they caused. My friends and I were doing nothing wrong. I want to thank my fans for sticking with me during this difficult time."

"These people are despicable," said Morelli. "They knew that they changed these people's lives forever and killed somebody." Morelli continued as Walmart tries to lay the blame on the limo's passengers. "They're good blame shifters. I guess that's how they make $783 billion a year, shifting the blame."

We wish the best for Tracy and that he will be able to make a full recovery.
