Shahs Of Sunset star Asa Rahmati launched her Diamond Water company in summer 2013 after months of preparation, some of which was seen on the hit Bravo show. But as exciting as that was for Rahmati, she has since been slapped with a lawsuit.
In Oct. 2013, Gastroceuticals, LLC filed a lawsuit against Diamond Water, LLC, claiming they own a registered trademark for “Dymund.” Since "Diamond" is so similar to "Dymund," Gastroceuticals, LLC feels that consumers will be confused about which water bottle is which.
According to Radar Online, Gastroceuticals, LLC is asking for a jury trial and requesting Rahmati’s competing company cancels its trademark.
"The name of her water bottle company will cause confusion with their water bottle name, Dymund, ultimately causing harm to the success of their business," Radar reported. "The plaintiff’s are asking for an unspecified amount in damages, but are also seeking attorneys’ fees, punitive damages, costs of the suit incurred herein and any other relief the court deems just."
On Jan. 7, 2014, Rahmati responded to the claims.
“Diamond Water generally denies any and all allegations, speculation, factual assertions, and claims for relief made by Plaintiff in its complaint except those expressly admitted below,” the response reads.
Rahmati said that she legally owns trademarks for both Diamond Water and Asa’s Diamond Water and that consumers will not confuse them with Gastroceuticals, LLC's “Dymund” since it isn't a well-known brand.
Rahmati's company is asking the lawsuit be thrown out and that their legal costs be paid for by Gastroceuticals, LLC.
A judge has not yet ruled in this case.
