Rick Ross and Jermaine Jackson have filed a copyright infringement lawsuit against LMFAO over the allegedly illegal use of the phrase, "Everyday I'm Shufflin'" in their hit single, "Party Rock Anthem."
The Hollywood Reporter announced last week that the former members of LMFAO (the band broke up in 2013), Stefan Kendal Gordy (Redfoo) and Skyler Austen Gordy (SkyBlu), along with Kobalt Music Publishing and Kia Motors America (who uses the song in a commercial), are listed as defendants in a new lawsuit which claims their 2010 hit "Everyday I'm Shufflin'" is a rip off of Ross' "Hustlin.'"
"The use of 'Hustin' in 'Party Rock Anthem' is readily apparent, despite the slight change from 'Everyday I'm hustlin' to 'Everyday I'm shufflin' and constitutes, inter alia, the creation of an unauthorized derivative work," the suit claims, also adding that the lyric is "performed in a manner to sound like" Ross' track and "is an obvious attempt to capitalize on the fame and success of Hustin."
Ross and Jackson also point out that "the phrase is so important to the success of 'Party Rock Anthem' that LMFAO launched a highly successful clothing line, Party Rock Clothing, that features the phrase on T-shirts and other clothing items."
According to the plaintiffs, they have issued warnings to the defendants, but have gotten no response.
Ross is currently seeking an injunction and maximum statutory damages.
