'Shahs Of Sunset' Star Asa Rahmati Scores Victory In Trademark Lawsuit
Shahs Of Sunset star Asa Rahmati has scored a legal victory in the trademark infringement case brought against her and her company, Diamond Water, LLC.
On Feb. 12, Radar Online reported that a federal court judge shot down Gastroceuticals, LCC, refusing to grant an injunction against Rahmati’s Diamond Water. In their suit, Gastroceuticals alleged that consumers would confuse the brands because "Diamond" was so similar to "Dymund," and because their bottles looked alike. However, the judge disagreed, claiming consumers wouldn't mistake the lesser known brand with Rahmati's water because Rahmati is much more popular.
In Oct. 2013, Gastroceuticals, LLC filed a lawsuit against Diamond Water, LLC, claiming their product was too similar to their own trademarked Dymund brand. In the suit, Gastroceuticals, LLC demanded a jury trial and requested Diamond Water, LCC canceled their trademark.
Since the lawsuit was filed, Rahmati has insisted she lawfully owns trademarks for Diamond Water, as well as Asa’s Diamond Water. She also maintains that any allegation of consumer confusion is false.
The case is still consider to be "pending" in federal court.
